Terms and Conditions – Diamond Paints (Product Sales)

1. Definitions

• “Company” refers to Diamond Paints.
• “Customer” refers to the purchaser of goods.
• “Goods” refers to all paints, coatings, and related products supplied by the Company.

2. Orders & Acceptance

• All orders are subject to acceptance by the Company.
• Once an order for custom-mixed paint is confirmed, it cannot be cancelled or amended.
• The Customer is responsible for ensuring all order details are correct before confirmation.

3. Colour Matching & Variations

• The Company will match colours as closely as possible based on provided references (e.g. samples, codes, or swatches).
• Exact colour matches are not guaranteed due to:
  • Lighting conditions
  • Surface texture
  • Application method
• The Customer is strongly advised to request a test sample before placing a full order.

4. Returns & Refunds

• Custom-mixed paints are non-refundable and non-returnable unless faulty.
• Standard (non-mixed) products may be returned within 14 days if unopened and in original condition.
• Any issues must be reported within 48 hours of delivery.

5. Product Use & Responsibility

• The Customer is responsible for:
  • Ensuring the product is suitable for their intended use
  • Following all application instructions
• The Company is not liable for poor results due to incorrect application, preparation, or environmental conditions.

6. Storage & Shelf Life

• Paint must be stored in a cool, dry, frost-free environment.
• Improper storage may affect product performance and void any claims.

7. Pricing & Payment

• All prices are subject to change without notice.
• Full payment is required before dispatch unless otherwise agreed.
• The Company reserves the right to withhold goods until payment is received.

8. Delivery

• Delivery times are estimates only and not guaranteed.
• The Company is not liable for delays caused by couriers or external factors.
• Risk passes to the Customer upon delivery.

9. Liability

• The Company’s liability is limited to the value of the goods supplied.
• The Company is not liable for:
  • Indirect or consequential losses
  • Labour costs or reapplication costs
  • Damage caused by misuse or incorrect application

10. Warranty & Defects

• Products are guaranteed against manufacturing defects only.
• Any claims must be supported with evidence (photos, batch numbers, etc.).
• The Company may offer replacement product at its discretion.

11. Health & Safety

• Customers must follow all safety instructions on product labels.
• Appropriate PPE (e.g. masks, gloves) should be used when applying paints.

12. Intellectual Property

• All colour formulations and mixes remain the property of Diamond Paints.
• Reproduction or resale of custom formulations is not permitted without consent.

13. Colour Satisfaction Disclaimer

Due to the bespoke nature of custom-mixed paints, Diamond Paints does not accept responsibility for colour dissatisfaction once the product has been used or applied. Customers are encouraged to test colours prior to full application.
